1. Introduction

Welcome to the Shower Parts website ("the Website"). These terms and conditions govern your use of the Website and any purchases made through it. We reserve the right to update, modify, or replace these terms and conditions at any time. It is your responsibility to check for updates. Your continued use of the Website after any changes constitute acceptance of those changes.

2. Definitions

“We”, “our”, “us” or “Seller” means Shower Parts or any person acting on behalf of and with the authority of Newline Group Limited.

"You" refers to the user or customer.

“Goods” means the Goods supplied by the Seller to you (and where the context so permits shall include any supply of Services) and are as described on the order and/or invoice; and

“Services” shall mean all services supplied by the Seller to you and includes storage, freight or insurance for any Goods.

3. Website Content

3.1 All content on the Website, including but not limited to text, images, graphics, videos, and logos, are the property of Shower Parts and are protected by New Zealand and international copyright laws.

4. Privacy Policy

5. Products and Orders

5.1. Product Descriptions: We make every effort to ensure that product descriptions, images, and prices are accurate. However, we do not warrant that the content is error-free.

5.2. Orders: Placing an order on the Website constitutes an offer to purchase. All orders are subject to acceptance by us.

5.3. Pricing: Prices displayed on the Website are in New Zealand Dollars (NZD) and include Goods and Services Tax (GST), unless otherwise stated.

I. Prices are correct at the time of publication. However, We reserve the right to alter prices for any reason.

II. Shower Parts is the owner of the Goods until payment is received for all amounts owing for the Goods, including any storage and freight costs.

6. Payment

6.1 Payment Methods: We accept the following credit/debit cards: Visa, Mastercard, American Express, Union Pay, Diners Club, and Discover.

6.2 Security: We use secure Stripe, a secure payment gateway to protect your payment information. However, we are not liable for any unauthorized access or disclosure of your payment information.

7. Shipping & Delivery

7.1 Shipping Fees: Shipping fees are detailed during the checkout process.

7.2 Delivery Times: We make every effort to ensure timely delivery. However, we are not responsible for delays caused by external factors.

7.3 Delivery of Goods: If you do not give any notice of any alleged defect, or failure to comply with the Customer’s order within seven (7) days of delivery (time being of the essence), it shall be conclusively deemed that you have accepted delivery of the Goods.

8. Warranty

8.1 Subject to the conditions in clause 7.3, the Seller warrants that if any defect in, or damage to, the Goods manufactured by become apparent and are reported to the Seller within seven (7) days of the date of delivery (time being of the essence) then the Seller will either (at the Seller’s sole discretion) repair or replace the Goods.

8.2 The above warranty shall not cover any defect or damage which maybe caused or partly caused by or arise through:

I. your failure to properly maintain the Goods. Or

II. your failure to follow any instructions or guidelines provided by the Seller.

III. using the Goods otherwise than for their ordinary purpose or any application specified in an order; or

IV. the continued use of any Goods after any defect becomes apparent or would have become apparent to a reasonably prudent operator or user; or

V. fair wear and tear, any accident or disaster.

VI. The warranty shall cease if the Goods are repaired, altered, or overhauled without the Seller’s consent.

VII. The Seller shall not be liable for any delay in either replacing or repairing the Goods or in assessing any claim.

9. Returns & Refunds

9.1. Our Returns and Refunds policy outlines our commitment to compliance with the New Zealand Consumer Guarantee Act.

Eligibility

To be eligible for a return or refund, your purchase must meet the following conditions:

I. The purchase of goods is above $NZD80, unless the item is faulty or does not match the description provided.

III. The item must be returned within seven (7) days.

We’ll process the refund due to you as soon as possible. We will refund the price of the Goods in full, including the cost of sending the item to you. However, you will be responsible for the cost of returning the item to us.

II. We will usually refund any money received from you using the same method originally used by you to purchase the goods.

Exclusions

The following situations may be excluded from a refund or an exchange:

I. Change of mind or incorrect selection by customer.

II. Damage caused by misuse, improper installation, or neglect.

III. Normal wear and tear.

Returns Process

To initiate a return, please follow these steps:

I. Contact our Customer Service team at hello@showerparts.co.nz within 7 days of receiving the item, providing the following information:

Order number
Reason for return
Photos of the item, if applicable

I. Our Customer Service team will guide you through the return process, including providing a return authorization and the address for return.

II. Pack the item securely, including all original packaging and any accompanying accessories or documents.

III. Send the item back to us using a tracked and insured shipping method. We recommend using a carrier that provides tracking.

Inspection and Refund

Upon receiving the returned item, our team will inspect it to ensure it meets the eligibility criteria outlined. If the return is approved, we will process the refund to your original payment method within 5 working days.

Replacements and Exchanges

If a replacement is available, it will be sent to you promptly after approval of the return. If an exchange is not possible, a refund will be provided.

10. Cancellation

10.1 The Seller may cancel these terms and conditions or cancel delivery of Goods at any time before the Goods are delivered by giving written notice. On giving notice the Seller shall repay to the Customer any sums paid towards the Price. The Seller shall not be liable for any loss or damage whatever arising from such cancellation.

11. Limitation of Liability

To the maximum extent permitted by law, Shower Parts New Zealand shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in any way connected with the use of the Website.

12. Consumer Guarantees Act

This agreement is subject to the provisions of the Consumer Guarantees Act 1993 in all cases except where you are contracting within the terms of a trade/business (which cases are specifically excluded).

13. Privacy Act

13.1 Whenever you visit our website, our servers automatically record information about your usage of our website through ‘cookies’ and clickstream data.

13.2 Cookies are small pieces of information stored by your browser on your computer or mobile device. Cookies and clickstream data are used to maintain session information between your browser and the Seller’s website and identify things related to your use of the website such as the time, date, and URL of the pages you visit, your IP address, your location and browser software. Some computers and mobile devices also permit your location to be shared with the Seller (often referred to as geo-location data). 13.3 The Seller uses information obtained this way in order to learn about your preferences so that it may improve the Seller’s website and the Goods offered through it.

13.7 contact you if necessary; and

13.9 If you are an individual the authorities under clause 10.4 are authorities or consents for the purposes of the Privacy Act 1993.

13.10 You have the right to request a copy of the information about you retained by the Seller and the right to request that the Seller to correct any incorrect information about you.

14.1 You are responsible for your use of this website.

14.2 You may not download, modify, transmit, or otherwise use any material from this website for public or commercial purposes.

14.3 This website content, information and advice is free of charge (unless otherwise stipulated). However, you are responsible for your own network and connection charges.

14.4 Other than connecting to the Seller’s servers by HTTP requests using a web browser, you may not attempt to gain access to the Seller’s servers by any means including, without limitation, by using administrator passwords or by masquerading as an administrator while using this website or otherwise.

14.5 You must not disrupt, modify or interfere with this website or its associated software, hardware and servers in any way and you agree not to impede or interfere with others’ use of this website. You further agree not to alter or tamper with any information or materials on, or associated with, the Seller and/or this website.

15. General

15.1 If any provision of these terms and conditions shall be invalid, void, illegal or unenforceable the validity, existence, legality and enforceability of the remaining provisions shall not be affected.

15.2 These terms and conditions and any contract to which they apply shall be governed by the laws of New Zealand and are subject to the exclusive jurisdiction of the courts of New Zealand.

15.3 In the event of any breach of these terms and conditions by the Seller, your remedies shall be limited to damages and under no circumstances shall the liability of the Seller exceed the Price of the Goods.

15.4 You shall not be entitled to set off against or deduct from the Price any sums owed or claimed to be owed to you by the Seller.

15.5 The Seller may license or sub-contract all or any part of its rights and obligations without your consent.

15.6 The Seller reserves the right to review these terms and conditions at any time. If, following any such review, there is to be any change to these terms and conditions, then that change will take effect from the date on which the Seller notifies you of such change.
